Penebaker v. Hitt

Litigation Content

ICAP, in partnership with Law Forward and Stafford Rosenbaum, successfully represented Wisconsin taxpayers, voters, and legitimate presidential electors in a historic civil lawsuit against the individuals who orchestrated the 2020 “fake electors” scheme. The litigation targeted ten fraudulent electors and their primary legal architects—Trump campaign attorney James Troupis and advisor Kenneth Chesebro—who met at the Wisconsin State Capitol to cast and transmit unauthorized electoral votes. ICAP argued that this conspiracy was a deliberate attempt to subvert the will of Wisconsin voters and provide a pretext for disrupting the peaceful transfer of power on January 6, 2021. This case stands as the first successful civil effort in the nation to hold fake electors and their legal counsel accountable. The case settled in early 2024, with adminission on the part of the electors and the public release of thousands of pages of documents that helped shed light on the illegal scheme.
