ICAP was launched in 2017 amid increasing executive overreach and political violence that threatened democratic participation.
Our first case grew out of the violence that erupted during the “Unite the Right” rally in Charlottesville, Virginia, where armed private militias and white nationalist groups turned the city’s streets into a combat zone, terrifying residents, and obstructing the exercise of constitutional rights.
On behalf of the city, local businesses, and residential associations, ICAP brought a landmark lawsuit invoking Virginia’s anti-paramilitary laws and secured court orders preventing these groups from engaging in coordinated violence in Charlottesville ever again.
The establishment of private armies is inconsistent with a well-ordered society and enjoys no claim to protection under the law.

That early case became our blueprint: use every legal tool available—federal or state—to confront threats to constitutional rights, public safety, and democratic institutions.
From challenging unlawful private militias to suing the president for attempting to rewrite the Fourteenth Amendment’s guarantee of birthright citizenship, the rule of law is our compass.

We are led by attorneys with deep experience in trial and appellate advocacy, civil rights, national security, and criminal prosecution and defense. Our team often works in partnership with non-profit organizations, law firms, other pro bono counsel, and law school clinics to build coalitions that amplify impact.

Practicum Seminar
Every semester at Georgetown Law, ICAP attorneys teach a practicum seminar where students have a rare opportunity to learn how constitutional principles are defended in courtrooms and in the public square. Students receive academic credit while contributing directly to ICAP’s active cases and policy work.
The students are embedded in litigation teams where they have the opportunity to provide research support in developing legal theories; produce first drafts of motions and sections of legal briefs; participate in meetings with clients and partner organizations; and contribute to policy initiatives.
Many Georgetown Law alumni of this practicum have gone on to distinguished public-interest careers—federal and state clerkships, fellowships at public-interest organizations, and roles within the U.S. Department of Justice and other federal agencies.
