Countering threats to democratic governance.
We confront threats to democracy wherever they arise—using litigation, policy, and public education, to defend constitutional rights and hold power to account.
Issue Areas
Civil Liberties
We defend the rights of children, immigrants, LGBTQ+ individuals, people experiencing homelessness, and others whose constitutional protections are under attack.
Criminal Justice
We work to curb unlawful pretrial detention and unsafe prison conditions, challenge unfair bail practices, combat prosecutorial misconduct, ensure courtroom transparency, and confront the misuse of solitary confinement and the death penalty.
First Amendment
We challenge government action that suppresses constitutionality protected speech or religious exercise, defend individuals and organizations from government retaliation, and protect the freedom to organize, assemble, and speak out on matters of public concern.
Government Overreach
We challenge unlawful executive actions, defend independent agencies from political interference, protect due process when government oversteps, and ensure that no branch of government operates above the law.
Immigration
We defend the rights of immigrants and their families through challenges to unlawful immigration enforcement, detention, and deportation practices.
Policing
We challenge excessive use of force, combat unconstitutional policing practices, defend communities from unlawful searches and seizures, and support law enforcement policies that uphold both public safety and civil rights.
Political Violence & Paramilitaries
We challenge unlawful paramilitary activity, support state and federal legislation to combat private armed groups, advise elected officials and law enforcement on the legal tools available to them, and prepare legal responses to political violence before it escalates.
Second Amendment & Firearms Regulation
We defend gun safety legislation in court, support bans on assault-style weapons and high-capacity magazines, challenge the presence of firearms in sensitive places, and counter the legal arguments that would strike down common-sense protections that are consistent with the Second Amendment.
Supreme Court
ICAP has specialized expertise in defending civil rights victories before the Supreme Court. We have successfully defeated over 15 cert petitions and stay applications seeking reversal of important public interest wins in the courts of appeals, and we have served as lead counsel in some of the most significant civil rights cases before the Court in recent terms.
Voting Rights & Elections
We protect voters and voting rights organizations from harassment and intimidation, challenge state efforts to chill civic participation, and prepare rapid legal responses to threats against polling places, election workers, and elected officials.
