ICAP filed a brief in opposition on behalf of the respondent judicial candidate, opposing review of a Third Circuit decision holding that the Civil Rights Act of 1964’s materiality provision prohibited throwing out ballots that were undated but timely filed. The Supreme Court ultimately vacated the Third Circuit decision on mootness grounds.

ICAP represented the nonprofit Al Otro Lado, Inc., and a class of asylum seekers before the Supreme Court in defending a Ninth Circuit decision striking down a turnback policy under which border officers physically blocked asylum seekers arriving at ports of entry in order to prevent them from lawfully presenting their asylum claims.
