In partnership with the immigrant advocacy groups that initially filed the suit, ICAP represented the nonprofit Al Otro Lado, Inc., and a class of asylum seekers before the Supreme Court in defending a Ninth Circuit decision striking down a turnback policy under which border officers physically blocked asylum seekers arriving at ports of entry in order to prevent them from lawfully presenting their asylum claims. ICAP Supreme Court Director Kelsi Corkran argued the case before the Supreme Court on March 24, 2026. On June 25, 2026, the Court ruled 6–3 in favor of the Trump administration. The decision was accompanied by a powerful dissent by Justice Sotomayor, who explained that the Court’s decision was an affront to congressional authority over immigration matters with devastating humanitarian consequences.
