ICAP, in partnership with Civil Rights Corps, represents a class of current and former pretrial detainees in a constitutional challenge to the bail system in Prince George’s County, Maryland. The lawsuit targets a “two-phase” process where, after a judge determines a person is eligible for release, they are referred to the County’s Pretrial Division for a second, discretionary screening. In practice, this allows jail officials—rather than a judge—to decide whether, when, and under what conditions a person is actually released. The complaint alleges that this extra-judicial process often leaves individuals languishing in jail for weeks or months without a clear explanation or a meaningful way to challenge their continued detention.
