In collaboration with co-counsel, ICAP represented Andrew Fields, a federal prisoner who was subjected to egregious physical abuse by prison guards who then sabotaged his efforts to file an administrative complaint. Mr. Fields filed suit against the prison guards for violating his Eighth Amendment right against cruel and unusual punishment , and ICAP entered the litigation to oppose Supreme Court review of the Fourth Circuit’s decision to allow Mr. Fields’ claims to proceed. On June 30, 2025, the Supreme Court reversed, holding that no cause of action exists for Eighth Amendment claims of physical assault by federal prison guards.
