ICAP represented, in certain appellate proceedings, Jose Ageo Luna Vanegas and similarly situated migrant workers in a federal wage-and-hour lawsuit against Signet Builders, Inc. The plaintiffs, hired under H-2A visas for construction work on farms, allege that Signet misclassified them as “agricultural workers” to avoid paying the overtime rates required by the Fair Labor Standards Act (FLSA). ICAP represented plaintiffs in opposing Signet Builder’s petition for certiorari on the scope of the FLSA, and later represented plaintiffs in an appeal challenging the district court’s certification of a nationwide collective action of similarly situated workers.
