Lewis County v. Helphenstine

ICAP represents Julie Helphenstine in a case arising from the death of her husband in pretrial detention due to inadequate medical care. We successfully opposed Supreme Court review of a Sixth Circuit decision establishing the standard for deliberate indifference claims brought by pretrial detainees under the Fourteenth Amendment. The Supreme Court denied certiorari, preserving the favorable Sixth Circuit precedent.

Mullin v. Al Otro Lado

ICAP represented the nonprofit Al Otro Lado, Inc., and a class of asylum seekers before the Supreme Court in defending a Ninth Circuit decision striking down a turnback policy under which border officers physically blocked asylum seekers arriving at ports of entry in order to prevent them from lawfully presenting their asylum claims.

Ermold v. Davis

ICAP represented David Ermold and David Moore, a same-sex couple who were unlawfully denied a marriage license by then-Rowan County Clerk Kim Davis, in defiance of the Supreme Court’s landmark decision in Obergefell v. Hodges, which established the fundamental right of same-sex couples to marry.
