ICAP filed a Freedom of Information Act (FOIA) lawsuit against U.S. Citizenship and Immigration Services (USCIS) to uncover the data and internal justifications behind the “Public Charge Rule”, which granted the government expansive authority to deny noncitizens admission to the U.S. on the ground that they are “likely to become a “public charge””.
The case resulted in a stipulated dismissal in October 2021, following the production of responsive documents that shed light on the administrative machinery behind one of the most significant shifts in public charge policy in over a century.
