JUST FILED: ICAP Teams with House of Representatives to Fight Unlawful Census Memo

The census is the bedrock of American democracy, allocating political power in the United States for a decade to come.  Now, President Trump has ratcheted up his campaign to distort the census, issuing a memo calling for the apportionment of the House of Representatives to exclude undocumented immigrants.  It’s a constitutional abomination—indeed, contrary not just to the text of the Fourteenth Amendment but also to federal statutes, Supreme Court guidance, and the democratic principle of congressional representation of all communities subject to congressional lawmaking and oversight.

The Institute for Constitutional Advocacy and Protection teamed up with the House of Representatives to fight the President’s earlier unlawful attempt to add a citizenship question to the 2020 Census.  Now, we’ve teamed up again with the House, along with the law firm Debevoise & Plimpton, to challenge the President’s unconstitutional new census memo.  Check out here the brief we’ve just filed, which explains in detail that “all three branches of the Federal Government have long understood that the Constitution requires that the Congressional apportionment base encompass all ‘persons’ residing in each State—irrespective of citizenship or immigration status.”
