ICAP’S 2026 Annual Report!
2026 has been a monumental year for our country as we celebrate the 250th anniversary of the Declaration of Independence while facing profound and unprecedented threats to our Constitution and democratic institutions. We are proud to share our 2026 Annual Report detailing ICAP’s work combating these threats over the past year. As you’ll see in these pages, we filed 57 legal briefs at every level of the judiciary—from state and federal trial and appellate courts to the U.S. Supreme Court. We also continued to work closely with state and local governmental officials to develop winning litigation and policy strategies for protecting constitutional rights, members of Congress to hold the Executive Branch accountable, and advocates and activists to protect voters’ freedoms in the upcoming elections. Through these efforts and with your support, we achieved legal victories for immigrants, veterans, same-sex couples, non-profits, and the constitutional principles that underlie our democratic republic.
And we are not slowing down! In just the last two weeks, we:
- Moved for a preliminary injunction or temporary restraining order preventing the Administration from enforcing the President’s newest Executive Order purporting to strip citizenship from babies born to certain classes of immigrants, in defiance of the Supreme Court’s June decision.
- Won our motion to dismiss a lawsuit brought by the Trump Administration seeking to compel the Sheriff of Washtenaw County, Michigan, to detain people based solely on administrative ICE detainer requests—beyond when they would otherwise be released—without a judicial warrant based on probable cause of a crime.
- Filed suit on behalf of former Assistant U.S. Attorney Sunita Doddamani, challenging the retaliatory decision of Trump officials to fire her for her work on a successful FACE Act prosecution of defendants who obstructed access to a reproductive health clinic.
- Filed an appellate brief on behalf of Freedom of the Press Foundation and CREW defending the constitutionality of the Presidential Records Act and a preliminary injunction stopping the White House Executive Office of the President from failing to preserve presidential records.
