The prosecution relied on a Pennsylvania statute criminalizing the use of recording devices in court regardless of whether the act was disruptive. ICAP argued the charges constituted a violation of the First Amendment and selective prosecution aimed at a judicial critic.
This constitutional defense led the Commonwealth to dismiss all charges in January 2021, securing a victory for courtroom transparency and the right to document judicial environments.
