ICAP represented Travis Rice in challenging his prosecution under a statute prohibiting recording a person in a “judicial facility” without court approval. Mr. Rice argued that his act–recording a custody mediation in a conference room–did not constitute a “judicial facility” within the meaning of the statute, but even if the statute did prohibit making such a recording, the statute would be overbroad and facially unconstitutional as a prior restraint on speech violative of the First Amendment.
