ICAP represented a Michigan high school student, E.W., in a federal civil rights lawsuit against an assistant principal and a school resource officer following a violent physical encounter. The complaint alleged violations of the Fourth and Fourteenth Amendments, asserting that the officials used excessive force and conducted an unreasonable seizure during a routine disciplinary matter. By seeking to hold both the individual officials and the school district accountable, ICAP aims to establish stricter legal standards for the use of force by school staff and police. ICAP successfully defended the denial of summary judgment to defendnats on the excessive force claim on appeal, sending the case back to the district court for trial. The case evenutally settled.
