Alfaro v. Rempusheski

ICAP represented Kevin Alfaro and Georgana Szisza in a federal lawsuit seeking to vindicate their First Amendment rights. Mr. Alfaro shared on social media a photo of a police officer with criticism for how the officer had responded to a protest, requesting the public share the name of the officer’s identity. In retaliation for this post, the police department brought baseless felony charges against Mr. Alfaro and Ms. Szisza. ICAP argued that the retaliatory investigation and the filing of baseless criminal charges, were designed to suppress the plaintiffs’ speech and punish them for their vocal dissent. After the district court denied defendant’s motion to dismiss, the police department settled with the plaintiffs.
